Know what are the rights of elders?

It is our moral and legal responsibility to respect and take care of senior citizens in society. With aging, many elderly people face physical, mental and financial challenges. Many laws have been made to ensure the protection and security of their rights, which have provisions for the maintenance of the elderly and to prevent any kind of abuse against them.

Maintenance and Welfare of Parents and Senior Citizens Act, 2007

This Act has been made to protect the rights and interests of senior citizens. If a person abandons a senior citizen despite taking the responsibility of his care and protection, he can be punished with imprisonment up to three months or a fine of up to Rs 5000 or both.

Indian Civil Protection Code, 2023

If a child refuses to maintain his parents, the court can order him to pay monthly allowance to the parents. If the order is not followed, he can be punished for not paying the outstanding allowance for each month. One can be imprisoned for one month or till the amount is paid in full.

Hindu Adoption and Maintenance Act, 1956

According to section 20 of this Act, provision has been made for the maintenance of parents. This Act makes it clear that it is the responsibility of both the son and the daughter to take care of the parents. The adopted child is also bound to maintain his/her parents.
